About Participation of Ukrainian Delegation

The 48-th Session of the UN Commission on Narcotic Drugs (the Commission) was held on March 07-14, 2005 in Vienna.

The delegations of 51 member-countries of the Commission, 69 UN Member Countries (as observers) as well as representatives of the UN International Drugs Control Program (UNDCP), the International Narcotics Control Board (INCB), authorities and specialized UN institutions, governmental and non-governmental organizations having the status of consultants to the UN participated in the Session.

The Ukrainian Delegation was headed by Ms. Alekseyeva O. A., the Chairman of the Committee on Narcotic Drags Control of the Ministry of Health of Ukraine. Mr. Polurez Y. V. – the Deputy Permanent Representative in International Organizatons in Vienna, Mr. Soldatov Y. S. – the Deputy Chair of the Department for the Fight against trafficking of Narcotick Drugs of the Ministry of Internal Affairs of Ukraine, Mr. Grynenko I. M. – the Assistant to the Chair of the Department for the Fight against Organized Crime and Corruption of the State Security Service of Ukraine, Mr. Pokotylo V. I. – the Advisor to the Permanent Representative Office of Ukraine in International Organizations in Vienna, Mr. Omelyan V. V. – the Second Secretary of the Permanent Representative Office of Ukraine in International Organizations in Vienna and Mr. Viniychuk V. V. – the Attaché of the Task Force for New Threats of the Ministry of Foreign Affairs of Ukraine.

Pursuant to the Rules of ESCR the Presidium was elected as follows: the Chairman – Mr. S. K. Sharma (India), the First Vice-Chairman – Mr. Y. Polurez (Ukraine), Vice-Chairmans – Mr. M. R. Plum (France), Mr. L. A. Pádilla Menéndez, (Guatemala), and the Speaker – Mr. O. Mayeguene (Nigeria). For the purposes of organizational support to the Chairman the group consisting of heads of five regional groups was created. The members of the Group and elected officers established the extended bureau provided by the ESCR Resolution 1991/39 (ESCR), of June 21, 1991.

The Commission also established the full-structure Committee working in parallel to the plenary meetings of the Commission that considered 18 draft resolutions submitted by the Member Countries of the Commission.

The following major issues were on the Agenda:

1) Thematic debate on drug abuse prevention, treatment and rehabilitation:

a) Preventing HIV/AIDS and other blood-borne diseases in the context of drug abuse prevention;

2) Follow-up to the twentieth special session of the General Assembly: general overview and progress achieved by Governments in meeting the goals and targets for the year 2008 set out in the Political Declaration adopted by the Assembly at its twentieth special session;

3) Drug demand reduction:

a) Action Plan for the Implementation of the Declaration on the Guiding Principles of Drug Demand Reduction;

b) World situation with regard to drug abuse.

4) Illicit drug traffic and supply:

a) World situation with regard to drug trafficking and action taken by the subsidiary bodies of the Commission;

b) Follow-up to the twentieth special session of the General Assembly:

- Measures to promote judicial cooperation (extradition, mutual legal assistance, controlled delivery, trafficking by sea and law enforcement cooperation, including training);

- Fighting against money laundering;

- Action Plan on International Cooperation on the Eradication of Illicit Crops and on Alternative Development.

5) Implementation of the international drug control treaties:

a) Changes in the scope of control of substances;

b) International Narcotics Control Board;

c) Follow-up to the twentieth special session of the General Assembly:

- Measures to prevent the illicit manufacture, import, export, trafficking, distribution and diversion of precursors used in the illicit manufacture of narcotic drugs and psychotropic substances;

- Action Plan against Illicit Manufacture, Trafficking and Abuse of Amphetamine-type Stimulants and Their Precursors;

6) Policy directives to the drug programme of the United Nations Office on Drugs and Crime.

7) Strengthening the drug programme of the United Nations Office on Drugs and Crime and the role of the Commission on Narcotic Drugs as its governing body.

8) Administrative and budgetary issues;

The Session was open by Mr.Kosta, the General Director of the UN Branch in Vienna and the Executive Director of the UN Department on Narcotics and Crime, who gave the report concerning the outcome of activities of the Department in 2004 and pointed out the importance of acceleration of efforts of international community in the sphere of fighting against narcotic threat as well as the necessity of strengthening the attention to the issues of countering HIV/AIDS among drug addicted people in the countries worldwide.

The 20-th Special Session of the General Assembly adopted the Policy Statement and Declaration on General Principles of Drugs Demand Reduction and defined measures related to strengthening of international cooperation in fighting against international narcotic problems, including the following: Action Plan against Illicit Manufacture, Trafficking and Abuse of Amphetamine-type Stimulants and Their Precursors; measures for control of precursors, drugs and psychotropic substances; measures aimed at widening of cooperation in the sphere of law enforcement; measures related to fighting against money laundering; Action Plan on International Cooperation on the Eradication of Illicit Crops and on Alternative Development.

On the 20-th Special Session Member Countries defined the 2003 as a target period for development of a new and improvement of existing strategies and programs of drugs demand reduction in cooperation with health protection, social and law enforcement agencies and obliged to substantially succeed in drugs demand reduction until the year of 2008 in the following trends: existence of national strategy of drugs demand reduction; ability to estimate acuteness of this problem through accumulation of information and data analysis; ability to resolve this problem through application of prevention, treatment and rehabilitation measures as well as mitigation of negative consequences of drug abuse; establishment of partnership relations and cooperation mechanisms; availability of programs directed to the most perceptive or specific population groups; organization of campaigns in mass media as well as informational and propaganda campaigns; capability to estimate and take account of received lessons.

During the consideration of the issue „Follow-up to the twentieth special session of the General Assembly the all-embracing biennial report of the Executive Director, which allowed defining the precise view with regard to the worldwide drug problem measures conducted on national, regional and global levels was appreciated.

It was outlined that for the period from the Special Session of the General Assembly of 1998 most countries have approved balanced national strategies on drug control and created national coordination mechanisms to assure the measures in this field.

Such strategy was also adopted by the Ukrainian Government – the Program on Enforcement of the State Policy in the Field of Fighting Against Trafficking of Narcotic Drugs, Psychotropic Substances and Precursors for 2003 – 2010 that includes the strategic trends of activities for both central and local executive authorities, the State bodies and institutions, public organizations with regard to execution of organizational and legal measures on fighting against drug abuse and trafficking. Approved measures include the establishing and assurance of reduction in demand and supply of drugs and psychotropic substances, prevention of drug addiction, treatment and rehabilitation of drug addicted persons, mitigation of damages caused by use of drugs and psychotropic substances, due control in the field of the turnover of drugs, psychotropic substances and precursors, fighting against money laundering, blocking of income channels for dangerous drugs supply into Ukraine, discovering of illicit laboratories, improvements of forms and methods of international cooperation.

Execution of the Program is performed under control of the National Coordination Council on Drug Addiction under the Cabinet Ministers of Ukraine.

In the course of the Session the high emphasis was placed on the issue of strengthening the society potential in the context of prevention of drug abuse. It was admitted that it appears to be impossible to create an integral rehabilitation process structure without a solution for the problem of social influence to the process of drug demand, since the above processes are interrelated. The substantial and special role is assigned to the communities accounted for the highest levels of drug abuse. Their involvement into development and execution of respective measures concerning the solution of narcotic problem should be an integral part of the State policy in this field.

The estimation of potency of the projects accomplished as well as discovering and promotion of optimal projects have to be conducted upon receipt of actual data from rehabilitation centers and law enforcement agencies on indexes of both the reduction in number of newly registered drug users and cut of criminality level in a region. On the basis of such statistics the most effective projects for implementation in other communities have to be defined.

What is more important, all representatives who made reports with regard to the above issue, have admitted that international treaties remain the only effective international legal basis for drugs control. Therefore, countries participating in international treaties in the field of drugs control bear moral and legal responsibility for compliance with such treaties.

In the course of consideration the issue on the strategy of strengthening of the UN control over narcotics mechanism it was outlined, that the Commission should continue to play the leading role in strengthening of cooperation between UNDCP, recipient- and donor-countries. Simultaneously, the efforts of UNDCP in development of new financing strategy and diversification of financial sources and certain steps made by Executive Director for improvement of management and development of clear operative priorities were approved.

The Member Countries bordering to Afghanistan were anxious in their reports about the situation in this country and increased level of illicit manufacture of opium in the country.

The Representative of Luxembourg who currently heads the European Union made a report and drawn attention to the necessity of strengthening the international cooperation on all levels, particularly, within the Ministries of Justice and Law Enforcement Agencies being the imperative in prevention of and fighting against drug trafficking. The participants were provided with certain statistics.

As regards the tendencies and form of drug abuse worldwide it was admitted that the level of heroin abuse has been stabilized in many regions, however, in the Central Asia, Eastern Europe and Russian Federation the alarming tendencies in increasing the range of abuse of this drug are observed, in particular, lowering of age of person abusing the drug via injections. The South Asia is one more region of this kind. The abuse of cocaine remains highly serious problem in America. The production of cocaine in 2004 kept the general tendencies of recent years; Columbia remains the largest cocaine producer. The Commission was informed on increase of consumption of cannabis in many countries worldwide. The level of abuse of cannabis in Africa significantly increased within last five years. The anxiety was expressed concerning the permanent growth in cultivation of cannabis and extensive use of manures, overharvesting and destruction of forests for development of new cannabis plantations that could negatively impact ecosystems. Several speakers opposed the decrease of control over cannabis since such measures may become an obstacle for efforts against illicit cultivation and trafficking of narcotics in other regions of the world.

It was emphasized that Afghanistan remains the largest producer of Papaver somniferum. In this relation it was mentioned that for Afghanistan the wide-range support of international communities and cooperation between them will play the most important role.

The increased level of anxiety was caused by the tendencies of increased consumption of amphetamine class stimulators and increased amounts of such drugs seized in countries. It was admitted that fighting against illicit production/manufacturing and trafficking of synthetic opioids requires more intensive international cooperation, particularly, in the field of sharing the operative information and data on chemical substances.

The Western European Countries, mainly referred to in connection with illicit production of “ecstasy”, discussed the necessity of implementation the specific measures for solution of the problem, in particular, development of national projects in the sphere of prevention of “ecstasy” trafficking, creation of special task forces on investigation of cases related to synthetic opioids, etc.

In the course of debates on follow-ups related to implementation of Action Plan on International Cooperation on the Eradication of Illicit Crops and on Alternative Development the parties shared the national experience. The basic principles for strengthening of alternative development were defined.

The Commission recognized that all regions of cultivation of narcotics crops have common features: low level of development, absence of infrastructure, and poorness. In certain cases, governments carry out limited control over such regions resulting in raise of activity of criminal groups that sometimes have connection to terrorists. The alternative development should become a part of complex solution aimed at development of rural areas, creation of conditions motivating the rejection by respective groups of population from illicit cultivation of narcotic crops.

In the course of thematic discussion “Synthetic Opioids and Control over Precursors” all speakers agreed that in many regions worldwide the level of illicit production/manufacture and trafficking of synthetic drugs and abuse hereof have substantially increased. The participants recognized that it is of high importance to strengthen bilateral, regional and international cooperation between countries in order to improve the effectiveness of fighting against the problem of synthetic opioids. It is also reasonable to speed up on-line sharing of data and other information between the countries with regard to respective criminal groups, routs of trafficking and methods of criminal activities. For the purposes of facilitation of cooperation between the partners the governments should demand for unification of legal norms related to investigations and law enforcement operations and create communication network between law enforcement agencies.

In the report of INCB for 2004 provided by Mr. Khamid Ghodse, the President of INCB, the attention was drawn to situation in Afghanistan in the sphere of control over production of narcotic substances. It was admitted that the Government of Afghanistan achieved minor progress in this direction and adheres to its obligations under international treaties governing this field.

The speaker emphasized on effective measures of law enforcement agencies of the Netherlands against abuse of cannabis, in particular, its cultivation and street trade.

The INCB admitted that the United States is the largest market for heroin and other narcotic drugs in the world. The Head of the US Delegation, who specially arrived to the Session, elucidated that the United States has significantly succeeded in fighting against narcotic drugs.

It was also noted that the Russian Federation became the largest market in the Europe for Afghan heroin. There were no any comments from the Russian Federation in this regard. The UN Committee on Drugs Control presented its annual official report for 2004 in which, alongside with issues on combination of strategies for reduction of drugs and psychotropic substances demand and supply and analysis of its current status worldwide, the analysis of activity of the International system on control over narcotic drugs, psychotropic substances and precursors was presented, in particular, entering of countries to international treaties on narcotics control, cooperation with governments, prevention of flow-out to illicit movement, control measures, assurance of narcotic drugs and psychotropic substances for legal purposes, etc.

It was also admitted that not all countries joined the UN International Conventions and became an integral part of international drugs control system. Such countries were requested to ratify such conventions in accordance with the set procedure.

The International Narcotics Control Board in its annual report for 2004 analyzed the results of Ukrainian Government in the field of implementation of the Committee’s recommendations developed after the visit of the INCB’s Mission to Ukraine. INCB with great satisfaction admitted that Ukrainian Government adheres to recommendations and has significantly succeeded in the sphere of narcotic drugs control. In particular, INCB admitted the strengthening of the role of Ukrainian Committee on Narcotic Drags Control in the system of administrative bodies and strengthening of its role as a coordinator of the activities of certain authorities responsible for narcotic drugs control in Ukraine.

Ukraine is the party to above three UN Conventions on Drugs, Psychotropic Substances and Precursors Control, in particular, the Unified Convention on Narcotic Substances of 1961, the Convention on Psychotropic Substances of 1971, the UN Convention on Fighting against Illicit Trafficking of Narcotic Drugs and Psychotropic Substances of 1988. Ukraine joined to the Protocol of 1972 on Amendments to the Convention of 1961 and became one of the first countries of former USSR which adopted the National legislation in full compliance with above international treaties and laws against money laundering.

The Ukrainian Government approved the List of Narcotic Drugs, Psychotropic Substances and Precursors containing 240 narcotic drugs and psychotropic substances and 23 precursors defined by the UN Conventions of 1961, 1971, 1988 being under international and national control. The measures of proscription character were also adopted with regard to 50 highly dangerous narcotics and psychotropic substances not applicable in medical practice.

The State policy of Ukraine in the field of licit movement of drugs, psychotropic substances and precursors is aimed on creation of due control over the movement of above substances, limitation of movement for medical, industrial, scientific, educational purposes, prevention of flow-out of such substances from legal to illicit sector, reduction of drugs and psychotropic substances supply and demand, mitigation of damages caused by their abuse as well as decrease of offences related to their illicit trafficking.

For the purposes of implementation of international treaties, Ukraine, on regular basis, provides the UN International Narcotics Control Board with statistics on amount of narcotics, psychotropic substances and precursors being in licit movement in Ukraine, their export and import, spots and location of plantations of narcotic crops, amounts of seized drugs, psychotropic substances and precursors, defined by the Conventions.

In the course of consideration the question “Reduction of Drugs Demand” the Commission paid attention to the HIV / AIDS and other blood born diseases and to Action Plan for the Implementation of the Declaration on the Guiding Principles of Drug Demand Reduction and the situation in the field of drug abuse worldwide.

The Commission approved the report of 48th Session and provisional agenda of the next 49th Session.

Participants of the Meeting positively responded for announcement of Ukrainian delegation about detection and liquidation of several narcotic laboratories in Ukraine producing highly dangerous synthetic opioids. It was also pointed out on necessity to provide external support to our country, specifically technical, expert and consulting assistance for the purposes of fighting against international narcotic business.

Within the Commission the speech on behalf of Member Countries of GUUAM was initiated by Ukraine that received positive response from presented delegations, in particular, from representatives of Central-Eastern Europe. The speech, particularly, contained the support to the major role of UNODC as the international body in the sphere of fighting against illicit drug trafficking as well as concern on increase of heroin production in Afghanistan and activities of illicit laboratories in production of synthetic opioids. It was also proposed to strengthen technical cooperation with countries through the territory of which the narcotic transit is performed. The participants of the Commission were also informed on creation of GUUAM Virtual Centre for Fighting against Terrorism, Organized Crime and Illicit Drug Trafficking.

In the course of discussion on illicit supply of narcotic drugs, Ukrainian delegates informed the participants on the latest developments of Ukrainian law enforcement agencies in this field and shared experience with foreign colleagues.

In the course of the Session Ukrainian Delegation had a number of meetings, in particular, with delegations of the Unites States of America, Russian Federation, Hungary, Turkey, Poland for the purposes of sharing the experience in the field of fighting against illicit drug trafficking. Working meeting with Mr. Kosta concerning the interagency meeting on countering HIV/AIDS to be held in Moscow on March 31 – April 02, 2005, also took place.

Furthermore, on March 08 the extended talks with the delegation of Russian Federation took place. The following persons participated in the talks: Mr. V. Fedorov, the Deputy Director of the Federal Drugs Control Service, Mr. Rogov, the Vice Chairman of the Department of New Threats of the Ministry of Foreign Affairs of Russia, Mr. V. Zagrekov, the Deputy Permanent Representative of Russian Federation to the UN in Vienna, Ms. O. Myrolyubova, the Head of the Department of the Ministry of Industry and Energy. From the Ukrainian side: Ms. O. A. Alekseyeva, the Head of the Delegation and the Head of the Committee on Narcotic Drags Control of the Ministry of Health of Ukraine, Mr. Y. S. Soldatov, the Deputy Head of the Department on Fighting Against Illicit Drug Trafficking of the Ministry of Internal Affairs of Ukraine, Mr. I. M. Grynenko, the Assistant to the Head of the Main Department on Corruption and Organized Crime of the State Security Service of Ukraine, Mr. Omelyan V.V., the Second Secretary of the Permanent Representative Office of Ukraine in International Organizations in Vienna and Mr. Viniychuk V.V., the Attaché of the Division for New Threats of the Ministry of Foreign Affairs of Ukraine.

During the meeting the wide range of issues was discussed. In particular, Mr. V. Fedorov spoke about Federal Service on Narcotic Drugs Control established in July 2004, its goals and functions, informed on the results of its activity. Ms. O. Alekseyeva, in her turn, advised of the activities of the Committee on Narcotic Drags Control responsible for control of licit movement of narcotic drugs, psychotropic substances and precursors in Ukraine and cooperation with and submitting of reports to the International Committee on Drugs Control, and emphasized that the State Security Service of Ukraine and the Ministry of Internal Affairs of Ukraine fight against illicit drug trafficking in Ukraine. The parties shared their experience concerning current practice of control and fighting against illicit trafficking and abuse of drugs. At the end of the meeting Russian delegation provided a draft of model agreement between the Federal Service for Drugs Control of Russian Federation and competent authorities of other courtiers followed by the proposal to sign this agreement with competent Ukrainian authority.

On March 10 the meeting of Ms. Alekseyeva, the Chairman of the Committee on Narcotic Drags Control of the Ministry of Health of Ukraine and Ms. Gabor, the Deputy State Secretary on Narcotics of the Ministry of Children, Youth and Sport of Hungary was held. During the meeting the parties shared their opinions concerning mechanisms of countering drug addiction, prevention and treatment of drug addiction, rehabilitation of drug addicted persons and shared their experience of utilization of narcotic drugs, psychotropic substances and precursors for medical and other legal purposes.

During the Session the meeting chaired by Mr. A. Costa, the Deputy Chair of the UN General Secretary, General Director of the UN Branch in Vienna was held. The major topic of discussion was the organization of interagency conference on HIV / AIDS in Moscow on March 31 – April 2, 2005. Mr. A. Costa repeatedly emphasized the importance of such conference to be conducted on such high level since HIV / AIDS problem becomes more and more complicated, specifically for CIS countries where a number of HIV / AIDS compromised has multiply increased. Mr. A. Costa also advised that not all CIS countries, including Ukraine, confirmed their participation in the above event. Mr. A. Costa called to the participants of the Conference to make efforts for determination of a list of participants of the above event as soon as possible. The General Secretary of UNODC also informed that it is planed to sign the Declaration on HIV / AIDS under the results of the Conference, the draft of which was elaborated by the CIS Secretariat and to be sent to governments of each CIS country.

The members of Ukrainian delegation also participated in special meeting on operation of courts for treatment from drug abuse and in round table “Assistance to Public Policies and Practices in the Field of Health Care” as well as in discussion “Development of Effective Policy Against Narcotic Drugs in Afghanistan”.

Within the framework of participation in the session the delegation of Ukraine, on March 08, 2005, took part in International Symposium on Global Policy With Respect to Drugs organized by “Senlis Council” – non-governmental organization working in the EU countries and with support of the European Union, the activities of which are aimed at development of new policies of European security system. The Symposium was dedicated to development of effective narcotic policies in Afghanistan. Mr. Khabibulla Kadery, the Ministry on Fighting against Narcotic Drugs of Afghanistan, made a speech on the meeting and informed the participants on development of situation and steps made on governmental level. According to him, the further criminalization of narcoeconomy of the countries continues –in 2003 the farmers obtained 45 per cent of income from export of opium and opiates from the country, in 2004 – only 21 per cent e.g. 600 million US Dollars while 2,2 billion US Dollars account for drug dealers. The country depends on manufacture of narcotic drugs that contributes 60 per cent of annual revenue. 2 million of people, e.g. 10 per cent of population depend on cultivation of Papaver somniferum. At the same time, the government, through application of repressive measures, has succeeded in reduction of Papaver somniferum sowing that should result in substantial decrease of narcotic drugs production in the country. From the other side, the government apprehends that further repressive policies in this field may result in negative reaction of population, including appearance of armed uprising, since no alternative to cultivation of Papaver somniferum exists at the moment.

«Senlis Council» made a proposition with respect to implementation of temporary program on utilization of opium produced in Afghanistan for the purposes of pharmaceutical industry. From their point, this will require voluntary reduction in output of opium products in such key producing countries as Turkey, India and Australia.

In this respect the representative of Afghan Government informed that implementation of this program appears to be impossible due to the fact that any transactions related to opium and Papaver somniferum are prohibited under the Constitution of Afghanistan.

In the course of negotiations with Ukrainian delegation, representatives of «Senlis Council» offered to develop cooperation with their organization in various trends of security policy, European integration, and participation in scientific projects performed under its supervision and financial support.

On March 10, 2005, the Ukrainian delegation participated in the meeting on protection of human rights and fighting against HIV organized within the context of the UN Commission 48-th Session by the Open Society Institute, Soros Foundation and the Government of Brazil. The meeting was dedicated to the issues of implementation of substitutive therapy in many countries worldwide. In particular, despite the fact that that methadone is used as a major substitute to heroine in most countries worldwide, in Northern America and the EU countries there are tendencies of wide use of buprenorphine in substitutive and support therapies. The latter has a number of advantages and does not result in addiction being as protagonist and antagonist (methadone is just a protagonist as the heroine) and be applicable on initial stages of rehabilitation, that allows to cut the dose, and avoid overdosing. There is an obvious tendency of putting patients from methadone to buprenorphine in the United States. France has the widest experience in this field.

The members of Ukrainian delegation had a working meeting with Mr. Howard Sted, the Head of Scientific and Laboratory Department of the UN Office on Drugs and Crime and Ms. Eugenia Naydis, the scientific expert of this Department, with regard to creation of the National Criminalistic Narcotic Laboratory under the UN support in Ukraine. The above UN officers have informed the Ukrainian delegation on financing of the laboratory and further development plans, education and trainings for experts, solution of organizational issues. The question of legal regulation in exchange of samples of confiscated narcotics is highly important on national and international levels. The UN representatives requested the detailed description of action plan with regard to the year of 2007 and creation of the data base of narcotics samples (stage 2).

In the course of the Session the members of Ukrainian delegation had a working meeting with representatives of the USA delegation: Mr. Eric Rubin, the Director of the Office for Political Planning and Coordination of the Bureau on International Narcotic Business and Law Enforcement Activities, and Mr, Westley Clark, the Director of the Centre for Treatment of Chemical Addictions. The American delegation was informed on close cooperation of Ukrainian competent authorities with respective authorities of the United States, primarily with the US Drug Enforcement Agency (DEA), basing on similarity in estimations of level and acuteness of narcotic threat for national and international security, active position of Ukrainian State in fighting against drugs. The American party advised of granting the funds to Ukraine for improvement of policies in the field of fighting against drugs, law enforcement, social and medical programs and expressed its support to activities of new Ukrainian government, including its activities in prevention of drug addiction and narcotic business. The US representatives informed on plans of the US Government to expand the cooperation with Ukraine in various fields, including fighting against drugs.

During the drafting of resolutions the Ukrainian delegation took reasonable efforts in order to prevent any possible negative consequences for our country.

Ukraine co-authored in seven draft resolutions of the UN on narcotic substances:

1. “Assistance in sharing of information on new tendencies in the field of abuse of substances, which are not subject to control under international drugs control and conventions on illicit trafficking” (E/CN.7/2005/L.5/Rev.1).

2. “Demand for opiates and their supply for medical and scientific purposes” (E/CN.7/2005/L.11/Rev.1).

3. “Implementation of strategies for prevention of use of illicit drugs” (E/CN.7/2005/L.16/Rev.1).

4. “International support to the countries facing the problem of narcotic transit” (E/CN.7/2005/L.26/Rev.1).

5. “Strengthening of international cooperation for the purposes of prevention of illicit production and trafficking of narcotic drugs, psychotropic substances and precursors through prevention of flow-out from legal turnover and smuggling of precursors and equipment in context of Prizma Project, Purpur and Topaz operations (E/CN.7/2005/L.29).

6. “Strengthening of potential of communities in provision of information, organization of treatment and social services for persons infected with HIV / AIDS, and other blood transferred diseases in the context of abuse of drugs as well as strengthening of monitoring systems, evaluation and accounting” (E/CN.7/2005/L.30).

7. “Periodicity of meetings of the Heads of national bodies for compliance with drug laws of European countries” (E/CN.7/2005/L.31).

Conclusions and Propositions

For the purposes of implementation of resolutions of the 48-th Session and agreements reached within bilateral meetings the following shall be reasonable:

1. Taking into account the results of the meeting chaired by Mr. A. Costa, the General Director of the UN Vienna Branch, to charge the Permanent Representative Office of Ukraine in the CIS to forward the draft Declaration on HIV / AIDS to be adopted on ministerial meeting in Moscow on March 31 – April 02, 2005 to the Ministry of Foreign Affairs and other related Ministries and Agencies. To charge the respective agencies to develop the above draft document for the purposes of determination of Ukrainian position with respect to its execution.

2. To commit the interested ministries and agencies to develop the draft model agreement on fighting against illicit drug trafficking offered by the Management of the Federal Service of Russian Federation on Narcotic Drugs Control for the purposes of determination of Ukrainian position with respect to its execution.

3. Taking into account the topicality of fighting against drugs and recognized international role of our country in this field, to consider the issue of re-appointment of Ukraine into the Commission on Drugs for the next two-year period and, in case of such re-appointment to commit the Permanent Representative Office of Ukraine in the UN in New York to develop this issue and receive the required support from other country-members.

4. To commit all interested executive bodies to develop the issue of organization of the official visit of Mr. A. Costa, the General Director of the UN Vienna Branch, the Executive Director of the UNODC to Ukraine in second half-year of this year.

5. To commit all interested executive bodies to develop and submit to the Cabinet of Ministers of Ukraine the propositions on introduction of changes to the Regulation of the Cabinet of Ministers of Ukraine No. 877 dated June 04, 2003 “On Approval of the Program of Implementation in the Field of Fighting Against Illicit Drugs, Psychotropic Substances and Precursors trafficking for the 2003 – 2010 period” under the resolutions of the 48-th Session of the UN Commission on Narcotic Drugs, in particular, with regard to prevention of drug abuse and HIV / AIDS in the context of drug addiction, treatment, rehabilitation, resocialization of drug addicted persons, mitigation of damages caused by use of narcotic drugs and psychotropic substances.

6. For the purposes of due preparation of Ukrainian Delegation for participation in 49-th Session of the UN Commission on Narcotic Drugs (March – April 2006) to create an interagency task force for development of certain issues of provisional agenda related to performance of goals posed by the twentieth special session of the UN General Assembly by Ukraine.
